Preferred Credit, Inc. and First Preferred Finance, Inc.  (“PCICompany” “we” “our” “us”) have prepared this Privacy Policy to explain how we collect, use, protect, and disclose information and data when you use any PCI website (“Site”) and any PCI mobile application and application programming interfaces and other services offered by PCI. (“Services”) we offer in Canada. This Privacy Policy also explains your choices for managing your information preferences, including opting out of certain uses of your Personal Information (defined below). This Privacy Policy applies to all users of the Site and Services.

Privacy Policy Summary

What Personal Information we collect. The personal information we collect depends on how you interact with us. For example, we may collect name, contact information, account number, balance, other financial information, loan information, SIN (optional), and other information you provide us. If you apply for our products, we may collect information from third parties such as credit bureaus. This may include information about your character, reputation, employment, income, mode of living, credit worthiness, information establishing your identity, (e.g. name, date of birth, and contact information), information related to your loan, lease or other credit product or other transactions, and information about your financial and credit history, such as records of property, products or services obtained, or other purchasing or consuming histories.

How we Use the Personal Information we collect. We use the information we collect to provide our Site and Services, communicate with you, collect debts, support, personalize, and develop our products and services, create, maintain, customize, and secure your account, process your transactions, prevent fraud, personalize our Site and Services, and to conduct testing, research, analysis, and product development. We also use it to enforce our agreements, evaluate your current and ongoing credit worthiness and application, and to manage renewing, reviewing, modifying, and/or taking corrective action in respect of your account, and for legal purposes.

How we share the Personal Information we collect. We may share personal information with service providers that help us process the information as we describe in this policy. To maintain the accuracy of your credit history, information about your account may be submitted to credit reporting agencies. This may include a negative credit report  if you fail to fulfill the terms of your credit obligations, and your credit rating may suffer.

How we collect and use Information Using Technology. When you visit our Site, we may collect information using technologies such as cookies. This may include information such as: web browser, operating system, Internet Service Provider, IP address, session ID, how you move through and use our Site (e.g. pages viewed and links clicked), errors experienced, and the time and duration of your visits. We collect information including your browsing and search history on our Site, and your general geographic region. We use this information to help us understand and analyze how people use the Site and Services, to fix errors, and to enhance and improve Site and the Services. We also use these tools to remember preferences and authentication status, and to serve advertising and measure its effectiveness. We may work with service providers such as Google Analytics and Facebook to do this.

Your Choices. If you receive commercial email from us, you may unsubscribe using the unsubscribe mechanism in these emails. 1. Managing Your Information Preferences

You can access, correct, update, or change your Personal Information or opt out of receiving certain e-mails by emailing us at service@preferredcredit.com. You can also opt out of receiving marketing e-mails from us by following the link provided in all marketing e-mails. You are able to opt out of receiving marketing emails from us, however, you cannot opt out of receiving all e-mails from us, such as e-mails about the status of your account. Please note that if you choose to withdraw consent to our processing of personal information that is necessary for us to provide our products or services to you, we may be unable to provide those products or services to you.

Please note that in some cases we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons To help protect against fraudulent requests for access to your personal information, we may ask you for information to allow us to confirm that the person making the request is you or is authorized to access your information before granting access. For example, we may require you to verify your identity before you access your personal information.

2. Information We Collect

Personal Information

We collect information that personally identifies you, such as your name, address, phone number, mobile phone number, e-mail address, account number, balance and other financial information, loan information, social insurance number (if you choose to provide it, which is optional), and other personally identifiable information that you choose to provide us with or that you choose to include in your account (“Personal Information”). You may be asked to provide us with Personal Information when you register with the Site, use any of our Services, and at other times. We may also receive Personal Information about you from third parties with whom we work, such as credit bureaus and analytics services providers.

If you apply for credit from us or apply to be a dealer, you agree that we may investigate your credit in connection with the initial extension, review, or collection of your credit contract or application. From the date of your application and from time to time in the course of our relationship with you, you recognize that PCI may obtain consumer reports from consumer reporting organizations, including Equifax, Box 190, Jean Talon Station, Montreal, QC H1S 2Z2, and, TransUnion, 3115 Harvester Road, Suite 201 Burlington ON L7N3N8, on you,  including information regarding your character, reputation, employment, income, mode of living, credit worthiness, information establishing your identity, (e.g. name, date of birth, and contact information), information related to your loan, lease or other credit product or other transactions with us, and information about your financial and credit history, such as records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies (including between you and the dealer, and between you and PCI) (“Credit Report Information”).

If you apply for employment with us or seek to become a dealer associated with us, we may collect information you submit with your application, such as current or past job history or performance evaluations.Usage Data, Site Activity, and Cookies and other Technologies

We automatically collect information regarding the actions you take on the Site, and about your device and preferences (collectively “Usage Data”).

We use cookies (a small text file placed on your computer to identify your computer and web browser) and other technologies such as pixels and web beacons, to collect Usage Data, and may use anonymous identifiers (a random string of characters that may used for purposes similar to a cookie).

For example, each time you use the Site we automatically collect the type of web browser you use, your operating system, your Internet Service Provider, your IP address, session ID, how you move through and use our Site (such as what the pages of our Site you view, and what links you click), what errors you experience, and the time and duration of your visits to the Site. We also use technology to collect information including your browsing and search history on our Site (e.g. what pages you view and how long you spend on them and what materials you request), and your general geographic region from your IP address.

We use this information to help us understand and analyze how people use the Site and Services, to fix errors, and to enhance and improve Site and the Services we offer. We may also use these tools to remember your preferences, such as your language settings, and your authentication status as you navigate the Site (for example, so you do not need to login again for each new page you visit on our Site).

Some of our Service Providers (defined below) may use their own cookies, anonymous identifiers, or other tracking technologies to collect or receive information from the Site and elsewhere on the Internet  in connection with the services they perform for us. They may use that information to provide advertising and other services to us. For example, we work with:

  • Google Analytics to collect Usage Data and to analyze how users use the Site and Services. You can reset your web browser to refuse all cookies or to indicate when a cookie is being sent, however, certain features of the Site or Services may not work if you delete or disable cookies. You may also use the opt-out tools we link to above to control some of the technologies we use on our Site.  Please note your settings are device and browser specific, so if you use more than one browser or more than one device, you may need to set your preferences for each one. 3. How We Use Information and When We May Share and Disclose Information Generally

We use Personal Information for internal purposes only, such as:

If you enter a credit contract or dealer relationship with us, in addition to those purposes we describe in this policy, we use the Credit Report Information we collect to in connection with your application and may obtain and use subsequent reports in connection with the collection of your account or relationship with us, evaluating your current and ongoing credit worthiness and application, managing renewing, reviewing, modifying, and/or taking corrective action in respect of your account or relationship, and other uses not prohibited by law.  To maintain the accuracy of your credit history, information about your account may be submitted to credit reporting agencies. This may include a negative credit report  if you fail to fulfill the terms of your credit obligations, and your credit rating may suffer.

If you apply for employment with us, or to be a dealer, we use the information you provide to evaluate your application, and if it is accepted, to establish, manage, and terminate the employment or dealer relationship.

We may also use your Personal Information to provide more relevant search results from the search functions of the Site and the Services. We will not disclose Personal Information to third parties, including for their direct marketing purposes, without your consent, except as explained in this Privacy Policy, or as permitted or required by applicable law. We may disclose to third parties certain Usage Data regarding the Site and Services for internal purposes such as to provide and improve the Site and Services.

We may anonymize, aggregate or otherwise strip any personal information or other information we collect of all personally identifying characteristics and may use or share that aggregated, anonymized data with third parties for any purpose we deem appropriate.

 

4. Service Providers

From time to time, we may establish a business relationship with other businesses whom we believe trustworthy and who have confirmed that their privacy practices are consistent with ours (“Service Providers”). For example, we may contract with Service Providers to provide certain services, such as hosting and maintenance, data storage and management, and marketing and promotions. We only provide our Service Providers with the information necessary for them to perform these services on our behalf. Each Service Provider must agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, in order to help protect your Personal Information from unauthorized access, use, or disclosure. Service Providers are prohibited from using Personal Information other than as specified by us.

 

5. Other Transfers

We may share Personal Information and Usage Data with businesses controlling, controlled by, or under common control with our Company, for the purposes described in this privacy policy.

If our Company or any part of it is merged, acquired, or sold, or in the event of a transfer of some or all of our assets, we may disclose or transfer Personal Information and Usage Data in connection with such transaction.

 

6. Compliance with Laws and Law Enforcement

We cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We may disclose Personal Information and any other information about you to government or law enforcement officials or private parties if, in our discretion, we believe it is necessary or appropriate in order to respond to legal requests (including court orders and subpoenas), to protect the safety, property, or rights of our company or of any third party, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

 

7. Be Careful When You Share Information with Others

Please be aware that whenever you share information on any public area of the Site or Services, that information may be accessed by others. In addition, please remember that when you share information in any other communications with third parties, that information may be passed along or made public by others. This means that anyone with access to such information can potentially use it for any purpose, including sending unsolicited communications.

We maintain physical, electronic, and procedural safeguards to help protect the confidentiality and security of personal information transmitted to us. Information may be accessed by persons within our organization, or other entities described in this Privacy Policy, or our third-party service providers, who require such access to carry out the purposes described in this Privacy Policy, or as otherwise permitted or required by applicable law. Personal information we collect is primarily managed from our offices in St. Cloud, Minnesota, however, we may also store personal information in other locations, including in Minneapolis and Iowa.

However, no data transmission over the Internet or other network can be guaranteed to be 100% secure, and no security measures are 100% effective. As a result, while we strive to protect information transmitted on or through the Site or Services, we cannot and do not guarantee the security of any information you transmit on or through the Site or Services, and you do so at your own risk.

 

9. Links

Our Site and Services may contain links to other websites, including the payment site linked on the Site. A link to a third party’s website does not mean that we endorse it or that we are affiliated with it. We do not exercise control over third-party websites and are not responsible for their practices, including with respect to personal information. You access such third-party websites or content at your own risk. You should always read the privacy policy of a third-party website before providing any information to the website.

 

10. Children’s Privacy

The Site and Services are intended for users who are 13 years old or older. We do not knowingly collect Personal Information from children under the age of 13. If we become aware that we have inadvertently received Personal Information from a child under the age of 13, we will delete such information from our records.

 

11. Processing in the United States

Please be aware that your Personal Information and communications may be transferred to and maintained on servers or databases located outside your state, province/territory, or country. If you are located outside of the United States, please be advised that we process and store all information in the United States. The laws in the United States may not be as protective of your privacy as those in your location. By using the Site or Services, you are agreeing to the collection, use, transfer, and disclosure of your Personal Information and communications will be governed by the applicable laws in the United States. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States according to its laws. 12. Privacy Policy Changes

We may change this Privacy Policy from time to time. If we decide to change this Privacy Policy, we will inform you by posting the revised Privacy Policy on the Site. Those changes will go into effect on the “Revised” date shown in the revised Privacy Policy. By continuing to use the Site or Services, you are consenting to the revised Privacy Policy.
